Unless we make clear otherwise, and except to the extent that your express consent to any revised Terms is required under applicable law, continued access to or continued use of the Services after the Effective Date of the revised Terms constitutes your acceptance of the revised Terms.
By accepting these Terms, you represent that you have the legal authority to do so, and that, if you have accepted these Terms on behalf of any person or entity, you represent that you have legal authority to do so and that such person or entity agrees to be responsible to us if you or such person or entity violates these Terms. If you do not agree to every provision of these Terms, you may not, and we do not authorize you to, access or use the Services or any features provided therein.
By accessing or using the Services, you represent and warrant that you have not been previously suspended or removed from the Services or engaged in any activity that could result in suspension or removal from the Services.

- "DMCA" refers to the Digital Millennium Copyright Act of 1998, including any amendments;
- "Infringement" refers to the unauthorized or not permitted use of copyrighted material, patents, trademarks, or other intellectual property rights;
- "Marks" refers to the trademarks, service marks, logos, and other indicia used and displayed throughout the Services or in any rafflr Content;
- "PII" refers to personally identifiable information, as that term is defined under all applicable law;
- "Privacy Policy" refers to rafflr's privacy policy, and incorporated herein by reference;
- "rafflr", "we", "our" or "us" refers to rafflr and its service providers;
- "rafflr Content" refers to Content provided by rafflr to Users in connection with the Services, including, without limitation, the software, the products and the Site;
- "Raffle" refers to any reverse raffle created and managed through the rafflr platform;
- "Services" refers to the Site, mobile applications or connected applications, and other products, offerings and services provided on or through the Site or by or on behalf of rafflr;
- "Site" refers to the rafflr website(s) rafflr.io and www.rafflr.io;
- "Terms" or "Terms of Use" refers this Terms of Use, rafflr's Privacy Policy, all applicable laws, and all conditions or policies referenced herein;
- "User", "you" or "your" refers to any visitor to the Site or users of the Services, either individually or collectively;
- "User Content" refers to Content uploaded, transmitted or posted to the Services by a User;
3. What is rafflr?
rafflr is an online platform for managing reverse raffles. Users can create raffles, set ticket counts, manage drawings, track winners, and present raffles professionally. The platform provides tools for organizations to run reverse raffles efficiently and transparently.
4. Your Account and Obligations
In order to access and use certain areas or features of the Services, you may need to create an account, provide certain information and/or answer certain questions. By providing information and/or answering questions, you also consent to receive electronic communications from rafflr (e.g., via email or by posting notices to the Services). You should maintain copies of electronic communications from us by printing a paper copy or saving an electronic copy.
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services—subject to the Terms and the following restrictions in particular:
- You are responsible for your account. To use many of the Services, you will need to register and create an account with an email address and password. Each registration is for a single user only. You must provide us with accurate and complete information, and you must update your account information as needed to keep the information accurate and complete. You may not impersonate anyone else or violate any individual's rights. You are solely responsible for maintaining the confidentiality of your account and for all activities associated with or occurring under your account.
- Deleting your account. You may submit a request to delete your account by contacting us, but this will not automatically delete User Content, and we are under no obligation to do so. We may need to retain certain information as required by law or as necessary for our legitimate business purposes.
- You must be 18 years old. You must be 18 years or older to sign up for an account and use our Services. Organizations using our Services are responsible for ensuring their authorized users meet this requirement.
- Follow the law and our policies. You may not take any action that violates the law, infringes or violates anyone else's rights, or breaches any agreements or legal obligations that you have toward anyone. You may not use the Services for any illegal raffles or gambling activities where prohibited by law.
- Be truthful. Don't post information you know is false, misleading, or inaccurate. Don't do anything deceptive or fraudulent.
- Respect the rights of others. You may not threaten, abuse, harass, defame, or engage in behavior that is libelous, tortious, obscene, profane, or invasive of another person's privacy.
- Avoid spam and unsolicited communications. You may not distribute unsolicited or unauthorized advertising or promotional material, or any junk mail, spam, or chain letters.
- Respect the property of others. You may not distribute software viruses, or anything else designed to interfere with the proper function of the Site or Services.
- Do not engage in activities that affect the functioning of the Site. You may not bypass any measures that we have put in place to secure the Services, take actions to gain unauthorized access to any system, data, passwords, or other rafflr or User information.
- Respect privacy. When you use the Services, you may receive information about other Users. This information is provided purely for the purpose of managing raffles and may not be used for any other purposes without consent.
- You grant us the right to use your name and organization's logo in our marketing materials, subject to standard trademark usage guidelines that you provide to us.
5. Creating and Running Raffles
When you create a Raffle on the Site, you understand that you are responsible for:
- Ensuring your raffle complies with all applicable laws and regulations in your jurisdiction
- Managing ticket sales and distribution outside of the rafflr platform
- Conducting fair and transparent drawings
- Maintaining accurate records of your raffles
- Respecting the privacy of participants
6. Legal Obligations
As a User creating raffles, you must:
- Comply with all applicable laws and regulations regarding raffles, gaming, and charitable fundraising in your jurisdiction
- Obtain any necessary permits, licenses, or approvals required to conduct raffles
- Ensure that your use of the Services does not violate any laws or regulations
- Acknowledge that rafflr is a software tool only and does not provide legal advice
7. Fees and Payments
rafflr offers different pricing plans as described on our pricing page:
- Pay-As-You-Go: $47 per raffle
- Annual: $97 per year for unlimited raffles
- Lifetime: $497 one-time payment for lifetime access
By selecting a plan, you agree to pay the applicable fees. All payments are processed securely through Stripe. Prices are subject to change, but changes will not affect existing subscriptions. We offer a 30-day money-back guarantee as detailed on our pricing page.
8. Our Intellectual Property
rafflr's Services, Content, and Marks are the property of rafflr or its licensors, and may not be copied, imitated, or used, in whole or in part, without our prior written permission. Nothing contained in these Terms shall be construed as granting any license or right to use any Marks without our prior written permission.
9. Your Intellectual Property
Your User Content remains your property. When you submit User Content to the Site or via the Services, you grant rafflr a worldwide, non-exclusive, royalty-free, sublicensable, transferable right to use, reproduce, and display the User Content as necessary to provide the Services.
10. No Warranty
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RAFFLR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAFFLR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
12. Indemnification
You agree to defend, indemnify and hold harmless rafflr from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable attorneys' fees) arising from or relating to your breach of these Terms or violation of any laws.
13. Raffle Compliance
YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR RAFFLES COMPLY WITH ALL APPLICABLE LAWS AND REGULATIONS IN YOUR JURISDICTION. rafflr makes no representation or warranty regarding the legality of any raffle conducted using our Services. You agree to indemnify and hold rafflr harmless from any claims arising from your raffles.
14. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
YOU AND RAFFLR AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE FINALLY DECIDED BY BINDING ARBITRATION. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules & Procedures. By agreeing to these terms, you are waiving your right to trial by jury or to participate in a class action.
15. General Terms
These Terms constitute the entire agreement between you and rafflr. They are governed by the laws of the State of Arizona, United States, without regard to conflict of law provisions. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
